Terms & Conditions of Vehicle Hire

These Terms & Conditions apply to all vehicle hire bookings made with Bespoke Van Hire. The person making the booking and/or driving the vehicle is the Hirer. By making a booking, accepting a quotation, paying a booking payment, taking possession of a vehicle or signing a rental agreement, you confirm that you have read, understood and agreed to these Terms. These Terms apply alongside any booking confirmation, vehicle-specific terms, pricing information and other documents provided before or during your hire. Nothing in these Terms excludes or restricts any legal rights or remedies available under applicable UK consumer law. ⸻ 1. Our Services — Bespoke Van Hire provides self-drive vans and camper vans subject to availability. Man With a Van services may be provided under separate arrangements. These Terms primarily apply to self-drive vehicle hire. ⸻ 2. Booking a Vehicle — A booking request does not automatically guarantee that a vehicle is reserved. A booking becomes confirmed when we accept the booking, receive the required booking payment and provide booking confirmation. The vehicle, hire dates, collection and return arrangements, applicable price, booking payment and security deposit will be confirmed before or when the booking is accepted. You must provide accurate information. ⸻ 3. Booking Payment — A 20% booking payment is required where stated during the booking process. It is separate from the refundable security deposit. The remaining balance must be paid in accordance with your booking confirmation. ⸻ 4. Security Deposit — Some vehicles require a refundable security deposit between £150 and £750. The exact amount will be stated before booking. Reasonable deductions may relate to vehicle damage, loss, missing keys or equipment, late return, refuelling, cleaning, recovery, prohibited use or other properly due costs. Any undisputed balance is returned after inspection and resolution of applicable charges. ⸻ 5. Driver Eligibility — You must have the legal entitlement to drive the vehicle you hire. A standard UK car licence may generally cover vans up to 3,500kg, subject to your particular licence entitlement. Driving Licence Verification — We require a clear photograph or copy of your driving licence before collection and may request additional information to verify identity, address, entitlement and eligibility. Failure to provide required documentation may mean the vehicle cannot be released. ⸻ 7. Additional Drivers — Only drivers approved by Bespoke Van Hire may drive. Additional drivers must satisfy the same eligibility, licence and insurance requirements. The Hirer remains responsible for unauthorised driving and may remain responsible for an authorised additional driver’s acts and omissions, subject to law. ⸻ 8. Insurance — Bespoke Van Hire does not provide insurance as part of the advertised hire price. The vehicle must not be driven on public roads unless legally required motor insurance is in place and the driver is properly insured for the specific vehicle and use. Inspect it before leaving and report unrecorded damage or defects. We may record condition with photographs, video and inspection records. ⸻ 10. Vehicle Condition — We aim to provide vehicles that are safe, roadworthy, clean and maintained to the required standard. Report safety defects, warning lights or significant mechanical problems immediately and stop driving where continuing could create a safety risk. ⸻ 11. Existing Damage — Existing damage should be recorded before departure. Inspect carefully and notify us immediately if anything has not been recorded. This is consistent with established vehicle-rental inspection guidance. ⸻ 12. Damage During the Hire — You are responsible for taking reasonable care. Where legally responsible, you may be charged reasonable costs for damage to bodywork, bumpers, mirrors, wheels, tyres, glass, interior, roof, underside, camper equipment, fixtures, keys or supplied equipment. Ordinary fair wear and tear is not charged. ⸻ 13. Damage Assessment — We may use photographs, inspection reports, repair estimates, invoices, replacement costs and recovery costs to assess a charge. Deductions will be limited to amounts properly due and a security deposit does not automatically mean the entire deposit is retained. ⸻ 14. Fuel — Return the vehicle with the same fuel level as at collection. Reasonable refuelling costs may be charged where the level is lower. ⸻ 15. Mileage — Any mileage allowance or restriction will be clearly stated before confirmation. No additional mileage charge applies solely because you have driven further if no restriction was disclosed. ⸻ 16. Late Return — Return at the agreed time and contact us promptly if you will be late. Reasonable applicable charges may apply where the Hirer is responsible and may affect the security deposit. Charges will not be disproportionate or unreasonable. Any refund or adjustment depends on the booking terms and circumstances, subject to statutory rights. ⸻ 18. Vehicle Use — Use the vehicle responsibly, lawfully and in accordance with road traffic legislation, including speed limits, weight limits, loading, parking, licence entitlement, insurance, roadworthiness, towing and driver conduct. Secure all loads and do not carry anything that creates danger. ⸻ 20. Prohibited Use — Unless agreed in writing, do not use the vehicle for racing, speed testing, competitions, off-road driving, hazardous or illegal substances, unauthorised towing, excess passengers, unlawful purposes, unauthorised driving or any use that breaches insurance conditions. ⸻ 21. Smoking and Vaping — Smoking and vaping are not permitted inside vehicles unless authorised in writing. Reasonable remediation charges may apply for resulting damage, odour or specialist cleaning. ⸻ 22. Pets and Animals — Animals require prior permission. The Hirer remains responsible for preventing damage, excessive soiling and contamination. ⸻ 23. Keys and Equipment — Return all keys, accessories and supplied equipment, including camper equipment, bedding, charging equipment and other supplied items. Reasonable replacement or repair costs may apply for loss or damage. ⸻ 24. Accidents — Stop safely, protect yourself and others, contact emergency services where necessary, exchange legally required information, notify us promptly, provide accurate details and cooperate with reasonable investigation. Take photographs where safe. Do not admit liability on behalf of Bespoke Van Hire. ⸻ 25. Theft — Report theft to the police and notify us immediately. Provide the crime or incident reference where available and take reasonable precautions to protect the vehicle and keys. ⸻ 26. Breakdown and Mechanical Problems — Contact us promptly if a fault develops. Do not authorise significant repairs without approval unless immediate action is reasonably necessary for safety or to prevent further damage. Do not continue driving where it creates a safety risk. ⸻ 27. Fines, Penalties and Charges — The Hirer is responsible for legally recoverable parking, speeding, traffic, congestion, clean-air, toll and road-user charges arising during the hire, including properly disclosed administration costs. ⸻ 28. Parking and Security — Park lawfully, lock the vehicle when unattended, keep keys secure and never leave keys inside an unattended vehicle. ⸻ 29. Travel Outside the Permitted Area — Do not take the vehicle outside the UK or into restricted areas without prior written permission, required documentation and insurance. ⸻ 30. Towing — Do not tow unless expressly authorised in writing. Where authorised, comply with all legal requirements and weight limits. ⸻ 31. Camper Van Requirements — Take reasonable care of pop-top roofs, beds, cooking equipment, refrigeration, electrical and water systems, gas equipment, furniture, awnings and other camper facilities. Secure all external equipment before driving. ⸻ 32. Gas and Electrical Equipment — Follow the supplied instructions, use equipment safely and report suspected gas leaks, electrical faults or safety issues immediately. ⸻ 33. Cleaning and Return Condition — Return the vehicle reasonably clean and tidy. Excessive dirt, rubbish, spills, stains, smoke odour, pet contamination or unusual cleaning may result in a reasonable charge where the Hirer is responsible. ⸻ 34. Personal Belongings — The Hirer remains responsible for belongings left in the vehicle. Bespoke Van Hire is not responsible for loss or damage except where liability cannot lawfully be excluded. ⸻ 35. Booking Changes — Changes to vehicle, dates, collection or return times are subject to availability and are not confirmed until we confirm them. Additional disclosed and reasonable charges may apply. ⸻ 36. Cancellation by the Hirer — Cancellation terms will be provided before confirmation. Retained amounts must reflect agreed terms, applicable law and legitimate loss. Unfair or disproportionate charges will not be relied upon. Cancellation by Bespoke Van Hire — We may cancel where the vehicle becomes unavailable, eligibility or documentation requirements are not met, insurance is not confirmed, there is a serious breach, or the hire becomes unlawful or unsafe. Where the customer is not responsible, we will provide any refund or remedy required by law. ⸻ 38. Vehicle Substitution — If the booked vehicle becomes unavailable, we may offer a comparable alternative. Material changes will be explained and any required refund or remedy provided. ⸻ 39. Our Responsibilities — We will take reasonable care to provide the agreed vehicle or appropriate alternative, maintain vehicles, ensure road legality, carry out checks and provide the agreed service with reasonable care and skill. Statutory consumer protections remain applicable. ⸻ 40. Hirer Responsibilities — Provide accurate information, documentation, licence entitlement and insurance; use the vehicle responsibly; follow road laws; keep it secure; return it on time with the same fuel level; report incidents and faults; pay amounts properly due; return keys and equipment; and follow vehicle instructions. ⸻ 41. Liability — Nothing excludes or limits liability where unlawful, including death or personal injury caused by negligence, fraud or other liability that cannot legally be excluded. You are responsible only for losses and reasonable costs for which you are legally responsible. ⸻ 42. Consumer Rights — Nothing affects statutory rights. UK consumer protection legislation, including the Consumer Rights Act 2015, applies where relevant and unfair terms may not be enforceable. We aim to respond within a reasonable period. ⸻ 44. Privacy — Personal information may be processed for booking administration, licence verification, customer communication, payment processing, vehicle administration, legal compliance and managing damage, incidents and disputes, in accordance with our Privacy Policy. ⸻ 45. Website Information — Availability, specifications, photographs and pricing may change. Photographs are illustrative and may not show the exact vehicle. The confirmed booking documents apply. ⸻ 46. Events Outside Our Reasonable Control — We are not responsible for delay or failure caused by serious mechanical failure, accidents, extreme weather, road closures, government restrictions, emergencies, strikes or other circumstances that could not reasonably be prevented. Consumer rights remain unaffected. ⸻ 47. Changes to These Terms — We may update these Terms. Existing confirmed bookings will generally use the Terms agreed when made unless a legal change or agreed amendment applies. ⸻ 48. Severability — If a provision is invalid, unlawful or unenforceable, it will be interpreted or removed only as necessary and the remaining provisions continue. ⸻ 49. No Waiver — Failure to enforce a provision immediately does not permanently waive the right to enforce it later. ⸻ 50. Governing Law — These Terms are governed by the laws of England and Wales. Subject to mandatory consumer rights or applicable alternative dispute resolution, the courts of England and Wales have jurisdiction. ⸻ 51. Legal compliance: the Hirer must comply with applicable UK road traffic laws, loading limits, driving requirements and other legal requirements throughout the hire.
